We offer certain resources for download (such as assessment workbooks, scorecards, and checklists) at no charge. To access these resources, you must provide a valid name and email address. By submitting your information, you agree that:

• You will provide accurate and truthful information.
• You will not use a temporary, disposable, or falsified email address to obtain downloads.
• You will not redistribute, resell, or republish the downloaded materials as your own.
• We may follow up with you once regarding the resource you downloaded and your operational situation.

You may opt out of further emails from us at any time by replying to the email or contacting us using the information in Section 16.

4. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of applicable laws or regulations.

The Site uses third-party services to operate, including Formspree for form processing, Supabase for data storage, Resend for email delivery, and Plausible for analytics, and may link to external resources such as Google Sheets workbooks or LinkedIn. We are not responsible for the content, availability, or privacy practices of these third-party services. Your use of them is subject to their respective terms and policies.

7. Disclaimer of Warranties

The Site and all content, resources, and downloads are provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, Optichain Advisors disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Optichain Advisors’ total aggregate liability arising out of or related to your use of the Site exceed one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of these limitations may not apply to you.

11. No Guarantee of Availability

14. Entire Agreement and Severability

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Optichain Advisors regarding your use of the Site. If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Governing Law

These Terms of Use are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from these terms or your use of the Site shall be resolved in the courts of Hillsborough County, Florida.
